Report: Cheshire killer Joshua Komisarjevsky seeks new trial

CHESHIRE - An attorney is reportedly seeking a new trial for one of the convicted Cheshire home invasion killers.

The Hartford Courant reports that Joshua Komisarjevsky's lawyer said recorded calls into the police department on the morning of the triple murder were withheld during the original trial.

The attorney says the tapes could have been used in Komisarjevsky's defense.

Jennifer Hawke-Petit was forced to go to her bank and take out cash that day and the teller called police. The teller said a woman was withdrawing $15,000 and if police were called people would kill her husband and children.

Komisarjevsky and Steven Hayes are on death row for killing Jennifer Hawke-Petit and her two daughters.

Dr. William Petit was beaten, but survived.
