The Norwalk police officer who allegedly told another officer he was being investigated in connection with an alleged sex scandal went before a disciplinary board Tuesday.

But after five hours of closed-door negotiations at Norwalk City Hall, a settlement could not be reached. The hearing for Sgt. Stephen Couture was technically a public one, but all of the discussions took place either in private or in executive session.

The hearing centers around the case of former Norwalk police Lt. Tom Cummings, who allegedly had sex with three 15-year-old boys. Cummings has been in and out of Stamford Superior Court several times and is due back July 25.

Couture is accused of tipping-off Cummings that he was being investigated. "During executive session no action was taken. What we'll do now is discuss scheduling this hearing again at a later date," says Norwalk Police Department Commissioner Daniel O'Connor.

The hearing has been scheduled to continue on August 14 and 26.

Cummings is accused of enticing underage boys into having sex with him while he was an officer. Prosecutors say the incidents occurred while Cummings was working security at Norwalk High School.

Cummings pleaded not guilty in February to charges of enticing a minor, second-degree sexual assault and risk of injury to a minor.

If convicted, he faces a possible 115 years in prison.
