Motion filed to dismiss charges against estranged husband of missing New Canaan woman

The attorney for the estranged husband of Jennifer Dulos has filed a motion to dismiss charges against him as the investigation into her disappearance reaches two months. 

Norm Pattis filed the motion Wednesday and says the state has failed to present evidence from which it can make a case for the crimes.

Jennifer Dulos went missing on May 24, and New Canaan police say they have partnered with state police, federal law enforcement agencies, the Stamford and Norwalk state's attorney's offices and other Connecticut law enforcement agencies.

Police say they have received over 1,200 tips regarding the disappearance of Jennifer and nearly 80 responses with video surveillance from homes or businesses.

Since her disappearance, police have launched a missing person and a criminal investigation.

Jennifer's estranged husband Fotis Dulos and his girlfriend Michelle Troconis were arrested and accused of tampering with evidence and hindering the investigation.

Police say both Fotis Dulos and Troconis were caught on surveillance video in Hartford, which appears to show the two dumping bags inside trash cans throughout the city.

The bags were later located, and Jennifer Dulos' blood was found on rags inside of them.

Police say they also found blood stains and blood spatter in Jennifer Dulos' garage, along with her blood mixed with Fotis Dulos' DNA on the kitchen faucet inside her New Canaan home.

After a lengthy search of Waveny Park in New Canaan where Jennifer Dulos' car was found and a trash plant in Hartford. Officials have not found a body.

Fotis Dulos has hired attorney Norm Pattis who has requested Jennifer Dulos' medical records and suggested Jennifer Dulos may have faked her own death.

Pattis filed a motion to dismiss the charges against Fotis Dulos.

Retired FBI agent Kenneth Gray lectures at The University of New Haven. He says this case is far from being considered a cold case.

A spokesperson for Jennifer Dulos released a statement Wednesday, "The flow of support from the New Canaan, Farmington and Avon communities, individuals, as well as organizations, has helped us all going through this ordeal. We are very grateful for all of you. And we express our deepest thanks to the New Canaan and Connecticut state police for their tireless efforts on the case."

The five children remain with Jennifer Dulos' mother in Manhattan.

Fotis Dulos is scheduled to appear in court Aug. 2.
