Attorney reminds employers not to discriminate against returning workers with disabilities

As more people head back to work, a local attorney is reminding employers to be careful not to discriminate against older workers and those with disabilities.

As more people head back to work, a local attorney is reminding employers to be careful not to discriminate against older workers and those with disabilities.
Gary Phelan teaches at Quinnipiac Law School and is skilled in disability law. He says there are a lot issues coming up as seniors and workers with disabilities try to return to work.
Phelan says some employers think they may be taking risks by bringing back people who may be susceptible to getting coronavirus.
"What I think the best thing for employers to do is just have sort of an across the board policy where they just reach out to all employees and say if there's something unique to accommodate you, please let us know," said Phelan.
He says he has clients who feel they were either discriminated against or say their employer is not taking safety precautions seriously. He says it's important for the employee and their employer to talk about all their concerns.
Phelan says since COVID-19 employers are facing new challenges, like finding some employees have hidden disabilities like diabetes or epilepsy.
Phelan says employers do have a right to seek documentation from their employee regarding an illness.
He says anyone with concerns should refer to the Equal Employment Opportunity Commission website.
