The attorney for Raul Valle has filed a notice that he will appeal a recent decision allowing Valle to be retried in the death of Jimmy McGrath.
The filing comes after a judge denied Valle's motion to dismiss the remaining charges the Milford man faces for a fight at a Shelton home in 2022. Three people were injured and McGrath died.
Valle was acquitted in July 2025 of murder, intentional murder and intentional assault, but the jury was deadlocked on the lesser charges of reckless manslaughter and assault.
The state refiled to try Valle on just those counts.
