Queens man charged in alleged stairwell rape at White Plains City Center

Xavier Fonseca Overton, of Queens, has been charged with five counts of first-degree rape and one count of first-degree sexual abuse after allegedly raping an unconscious woman inside a stairwell at the White Plains City Center this week.

A Queens man has been charged after allegedly raping an unconscious woman inside a stairwell at the White Plains City Center.

The felony complaint alleges the incident happened between 10:45 p.m. on April 7 and 12:10 a.m. on April 8.

According to the complaint, video surveillance allegedly captured 22-year-old Xavier Fonseca Overton, of Astoria, repeatedly raping an unconscious woman.

Public Safety Commissioner Wade Hardy says the attack took place in the staircase leading to the Summit Apartments above the City Center Parking Garage.

Because the victim appeared to be unconscious, the felony complaint cites that she was unable to consent.

Overton is facing five counts of first-degree rape and one count of first-degree sexual abuse. He is due back in court on Monday.

The victim's name and status are not being released.

According to the officials, the suspect and the victim know each other prior to the assault.
