The attorney for Michelle Troconis has filed a motion to dismiss the criminal contempt charges against her.

Darnell Crosland filed the motion Tuesday, arguing that the state of Connecticut has failed to allege the essential elements required under the criminal contempt statute.

Troconis faces two counts of criminal contempt and is convicted in connection with the disappearance and presumed death of Jennifer Dulos.

"This prosecution," Crosland said, "not only stretches the contempt statute beyond recognition—it seeks to criminalize conduct that wasn't even Ms. Troconis' doing."

Troconis is scheduled to appear in court for the motion to dismiss on April 21.
