Fotis Dulos, who was accused in the killing of his missing wife from New Canaan, was declared dead at 5:32 p.m. in a Bronx hospital, according to his attorney Norm Pattis.
Attorneys for Fotis Dulos were at Jacobi Medical Center in the Bronx with his family Thursday, days after a suicide attempt by carbon monoxide inside his Farmington home.
“To those who contend that Mr. Dulos' death reflects a consciousness of guilt, we say no," said Pattis.
On Wednesday, Pattis called Fotis Dulos' situation "dire" and "grim" and said doctors would be meeting with family today to discuss the outlook.
Earlier Thursday, Pattis made a motion to preserve evidence regarding a note that was found inside his car after his suicide attempt.
A motion to preserve evidence states that "in the course of executing a search of Fotis Dulos's car, law enforcement officials recovered a note in which Mr. Dulos declared...his innocence of the infamous and heinous crimes that the State has accused him of and claimed his lawyers have the evidence to prove it."
In his statement, Pattis said they "have filed an filed an unusual motion in the Connecticut courts asking to substitute an estate for Fotis Dulos for him as a defendant to force the state to show its hand in a trial filled with evidence we think that amounts to no more than innuendo and unsupported suspicion."
"We think he's been wrongly accused, and we'll be seeking the discovery that we were supposed to get the other day,” said Pattis.
He continued: "We're not bitter, and we're not accusing anybody of having driven him to his death, but we wonder why in the court of public opinion, the presumption of innocence was so quickly satisfied."
Carrie Luft told News 12 on behalf of the family and friends of Jennifer Dulos: "This is a horrific tragedy all around. Please respect the privacy of the families and loved ones involved."
Jennifer Dulos' estranged husband was charged with felony murder, murder and kidnapping in connection to the disappearance of the New Canaan mother of five. She was last seen on May 24.

News 12 reported on unsealed documents in the case earlier this month, which detailed the bloody scene police found inside her garage -- blood stains on the floor, a parked car and garbage cans, along with bloody shoe impressions.
The documents also touch on Jennifer Dulos' alleged fear of Fotis Dulos, with whom she was in the midst of a contentious divorce.
They show Jennifer Dulos called New Canaan police following an argument with him in August 2017 -- nearly two years before she disappeared. No arrests were made in that incident.
Their children's nanny also told police about potential physical incidents between the couple, including one where she found Jennifer Dulos crying after Fotis Dulos allegedly tried to run her over with his vehicle.
In another, Fotis Dulos allegedly chased Jennifer Dulos through the house until she ran into a room, slammed the door and kept it shut with her body as Fotis Dulos banged on it.
Fotis Dulos' girlfriend Michelle Troconis is charged with conspiracy to commit murder. Former attorney Kent Mawhinney is also charged with conspiracy to commit murder. His arrest warrant alleges Mawhinney acted to give Fotis Dulos a fake alibi.
