The case against a former Stamford man accused of stealing nearly $1 million in a DoorDash scheme was dismissed in Stamford Court on Wednesday.
David Smith, 22, was shot to death in New Rochelle in January, and his case has now been dismissed in court.
The federal government will distribute more than $700,000 seized from Smith's apartment back to identifiable victims.
Smith was living in Mount Vernon, New York, at the time of his death, having moved there after Stamford police arrested him in June 2023 for what one investigator called a sophisticated phishing scam.
Frank Riccio, Smith's criminal defense attorney, said the ruling can help provide some closure.
"It's sad that he has all of these things still swirling around him even after his passing, but again at least this closes the chapter on this part of those swirling rumors and swirling allegations," Riccio said. "There could be some closure now; the family appreciates it, and now the family can move on."
