Fairfield officials filed an appeal on Tuesday for the Connecticut Siting Council's decision on the United Illuminating monopole project.
Town officials said they are challenging the legality of the Connecticut Siting Council’s decision on Feb. 16.
The decision in February granted UI a Certificate of Environmental Compatibility and Public Need for the construction of overhead transmission lines along a new route to the north side of Metro-North train tracks.
But the appeal by Fairfield officials claims the council violated its statutory obligation to balance the supposed need for the project with the environmental impact and that the council "violated due process."
The controversial project has been met with concerns from the community.
