Prosecutor still awaiting final report on cause of death for infant found in Milford motel bathtub

Kirkland has pleaded not guilty to his current charges of risk of injury to a child and cruelty to persons in connection to the death of his infant daughter on Aug. 21.

A Milford prosecutor is still awaiting a final report from the Office of the Chief Medical Examiner on a 3-month-old girl’s cause of death after she was found in a motel bathtub. Supervisory Assistant State’s Attorney Howard Stein said Thursday that until then, he won’t file additional charges against Dale Kirkland, the infant’s father.
“I've received some oral indications that they've reached conclusions, but they have not authored the report yet, so I'm not prepared to take any further action at this point until I'm in receipt of the report,” Stein said during a brief appearance by Kirkland in Milford Superior Court, adding the OCME assured him it’ll be done in a couple weeks.
In light of that, the judge set a new court date for Nov. 12.

Milford police were called to the Mayflower Motel that morning after a member of the cleaning staff went into a vacated room and discovered the infant “completely submerged underwater,” according to Kirkland’s arrest warrant.
Police said initially, the staff member noticed baby clothes, bags and a car seat had been left behind. Then, when she went into the bathroom, she saw a child’s bathing tub inside the bathtub and a baby inside the smaller tub, who was “submerged with her face under the water,” the warrant said. She was wearing a onesie and had no visible signs of trauma, according to the warrant.
Police said first responders attempted lifesaving measures on scene, but the infant was pronounced dead at the hospital.
An autopsy did not immediately determine cause of death, so further studies were needed, said an OCME spokesperson.
Surveillance video confirmed Kirkland checked into the motel the night before with his daughter and brought the same child's bathing tub she was later found in, according to the warrant. It also said when Kirkland checked out, he wore sunglasses and a black mask. During Kirkland’s arraignment, prosecutors alleged he left in a disguise.
Police arrested him several hours later in Bridgeport.
The warrant also included information from another motel guest, who told police she saw Kirkland and his daughter during their previous stay about a week before. That person said Kirkland had appeared disheveled and his daughter was dirty with a dirty diaper, according to the warrant. She also told police Kirkland was asking for cigarettes and “unknown drugs,” the warrant said.
According to court records, Kirkland was seeking full custody of his daughter due to the mother’s health and had notified the state Department of Children and Families of the situation. DCF officials confirmed they had been involved with the family for about a month prior to the baby's death, and said they are now conducting an investigation into what happened.
Kirkland is being held on $1 million bond. He has no prior criminal history.
