Brother of 7-year-old boy who starved to death and Newburgh School District reach settlement

An out-of-court settlement has been reached between the brother of a 7-year-old boy, who starved to death and the Newburgh School District.

Peter Cuacuas weighed 37 pounds when he died in 2021.

Authorities say he had been locked in a Newburgh apartment, owned by his caregiver, for a month before his death.

The lawsuit was filed in 2022 in New York State Supreme Court.

The boy's brother claimed the school district knew the child missed online classes from 2020 to 2021, but failed to notify child protective services.

The attorney for the brother confirmed the settlement, but said the terms were confidential.

A district statement says their thoughts remain with the student’s family and loved ones.

It goes on to say that, consistent with the terms of the agreement, the settlement includes no finding of wrongdoing or liability on the district’s part.

Cuacuas’s death resulted in two guilty pleas.

His primary caregiver, Leticia Bravo, was sentenced to 15 years in prison for manslaughter.

Peter Cuacuas's father, Arturo Cuacuas, pleaded guilty to criminally negligent homicide and was sentenced to prison.
