Crash that killed 5 Derby children ruled an accident 

Westchester County police have concluded the investigation into the Hutchinson River Parkway crash that killed five Derby minors on March 19. No criminal charges were filed.

Westchester County police have concluded the investigation into the Hutchinson River Parkway crash that killed five Derby residents on March 19. Officials say the crash has been ruled an accident, and no criminal charges were filed.
The accident happened on the northbound side of the parkway just north of the Mamaroneck Road exit in Scarsdale, New York.
Malik Smith, 16, was driving a rented Nissan Rogue. Officials said Smith did not have a driver’s license or a permit.
The victims included 17-year-old Anthony Billips, Jr., 12-year-old Zahnyiah Cross, 11-year-old Shawnell Cross, and 8-year-old Andrew Billips. 
Abraham Billips, 9, was the lone survivor of the accident. All of the children were related.
Police said they found no evidence that the vehicle was involved in a collision that forced it off the road.
Officials said a toxicology report determined that drugs or alcohol were not a factor in the crash. 
Police concluded that the driver 'most likely' fell asleep, causing the rented Nissan to go off the road.
