An attorney, who was asked to sue the state on behalf of a 6-year-old survivor of the Newtown massacre, is withdrawing that claim.

Attorney Irving Pinsky said his client suffered "emotional and psychological trauma and injury" during the shooting rampage.

He claimed the state failed to keep the 6-year-old safe.

Pinksy says he's reviewing new evidence on security at Sandy Hook Elementary School and could re-file the claim later.
